Terms And Conditions

These terms apply when you buy an AutoScan licence from this website or from our eBay shop. Please read them before you order. Our Refunds and Cancellation Policy and Privacy Notice also apply.

1. Who we are

AutoScan Software is the trading name of Antonio Jacquaye. Your contract is with him. We are not a limited company.

AutoScan is our own software. We own it and publish it ourselves. We are not a reseller. We are not registered for VAT, so no VAT is added to our prices and we cannot issue VAT invoices.

2. What you are buying

You are buying a licence key for one AutoScan edition or add-on, with a link to download it. Everything is digital. AutoScan runs on Windows 7 to 11. It connects to your vehicle through an ELM327 adapter, which we do not supply. Each product page says what that edition does, and those descriptions form part of your contract.

3. Prices and payment

Prices are in pounds sterling. The price shown at checkout is the total you pay. You can pay by card through Stripe, or through PayPal. We never see your card number. If we make an obvious mistake with a price, we will contact you. You can then pay the correct price or cancel for a full refund.

4. How the contract is made

Your order is an offer to buy. The contract is made when we email you to confirm your order. If we cannot accept your order, we will refund you in full.

5. Delivery

For website orders, we email your licence key and download link to the address you give at checkout. This normally takes minutes. If nothing arrives within 24 hours, check your spam folder, then email us. For eBay orders, we deliver your key as the listing describes.

6. Your right to cancel, and the consent we ask for

When you buy online you normally have 14 days to cancel, starting from the day the contract is made. For digital content, that right can end early if you ask for delivery straight away.

We send keys straight away, so our checkout shows a tick box. It is not ticked for you, and you cannot order without ticking it. It says:

I want my AutoScan licence key sent straight away. I understand that once the key has been sent I lose my right to cancel this order under the Consumer Contracts Regulations 2013. This does not affect my rights if the key or the software is faulty or not as described.

We repeat your consent and acknowledgement in your order confirmation email, so you have a lasting record of it.

• Before your key is sent, you can cancel for a full refund.
• Once your key is sent, you no longer have the right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
• If you did not give this consent, or we did not confirm it to you in writing, you keep your right to cancel for 14 days and pay nothing for the licence. This includes eBay orders, because eBay’s checkout does not show our tick box.

7. If your key or the software does not work

Under the Consumer Rights Act 2015, AutoScan must be of satisfactory quality, fit for its purpose and as described. If it is not:

• we will repair or replace it, for example by sending a working key or a fix;
• if we cannot, or cannot do so in a reasonable time and without significant inconvenience to you, you are entitled to a price reduction, which can be a full refund;
• if our software damages your device or other files because we did not use reasonable care and skill, we will repair the damage or pay you fair compensation.

Digital content has no 30-day “short-term right to reject”. The remedies above apply instead. We also give our own 14-day promise: see our Refunds and Cancellation Policy.

8. Your licence: a summary

• Licence, not ownership. We keep the copyright in AutoScan.
• Lifetime key. Your key does not expire, and there is no subscription. The version you have keeps working.
• Updates. New versions are included for 1 year with Standard, 2 years with Enhanced, and 3 years with Enhanced PLUS and ULTRA. ULTIMATE includes updates for as long as we maintain AutoScan.
• Use. Standard and Enhanced are for personal use. Enhanced PLUS, ULTRA and ULTIMATE also allow commercial use.
• One licence. Each key is one licence for one user: you, or your business for a commercial edition. Install it only on computers you use yourself. Do not share, publish or resell your key. A key unlocks only the edition it was sold for.
• Extras. Some editions and add-ons include extra programs, files, apps or training material that we did not write. The product page lists them. Where an item has its own licence from its maker, that licence also applies.
• Lost key. Email us and we will send it again, free.
• Do not copy, modify or reverse-engineer AutoScan, except where the law allows it.

9. The free trial

The free trial of AutoScan Standard or Enhanced needs no card and has no time limit. It reads fault codes from your vehicle. Clearing codes and saving or printing reports need a licence. A key unlocks the trial you have already installed. Please use the trial to check AutoScan with your vehicle and adapter before you buy.

10. Using AutoScan safely and lawfully

• Never operate a laptop or phone while you are driving.
• Clearing a fault code does not fix the fault. Do not clear a brake (ABS) or airbag (SRS) warning until the fault is repaired.
• Changing ECU software can affect your vehicle’s warranty, emissions, MOT and insurance. You are responsible for using these tools lawfully.

11. Our responsibility to you

We are responsible for foreseeable loss caused by us breaking this contract or not using reasonable care and skill. We do not exclude liability where the law does not allow it, including for death or personal injury caused by our negligence, for fraud, and under the Consumer Rights Act 2015. If you buy for a business, we are not liable for lost profits, and our total liability is limited to the price you paid.

12. Complaints

Please email info@autoscansoftware.com. We usually reply within one working day. If we cannot resolve your complaint, we will write to you by email to say so. We will name RetailADR (www.retailadr.org.uk), an approved alternative dispute resolution provider, and tell you whether we are willing to use it. RetailADR is free for consumers. Citizens Advice also gives free advice on 0808 223 1133.

13. Law and changes

These terms are governed by the law of England and Wales, and you can bring claims in its courts. If you live in Scotland or Northern Ireland, you can also use your local courts. The version of these terms shown when you ordered is the one that applies. Nothing in these terms affects your statutory rights.

Model cancellation form

You can use this form to cancel while you still have the right to. You do not have to. A clear email is enough.
